This privacy policy (“Privacy Policy”) discloses the privacy practices of the Koalify bv, with commercial name “Koalify”, Caritasstraat 13, 9090 Melle (Belgium), with company number 0777.799.745 (hereafter: “Koalify”).

We collect and process your personal data in accordance with the rules of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereafter GDPR), and the national legislation implementing the GDPR. 

This Privacy Policy describes the personal data we collect, how we use personal data, the security measures we take and your privacy rights.

1. Applicability

This Privacy Policy covers the information we collect about you when you use our products (such as the Koalify plugin) or services, or otherwise interact with us and which we use for our own purposes.

Please read this Privacy Policy before downloading the Koalify plugin.

We reserve the right to make changes to our Privacy Policy. We will do this whenever we make a meaningful change to the way we handle personal data. In such a case, we will publish a new version of the Privacy Policy to reflect the change. It is therefore recommended that you regularly consult our Privacy Policy.

2. Which personal data do we process and why?

Koalify may process personal data in a variety of ways:

• Account and profile information: email address, first and last name of contact person, phone number.

We process certain personal data about you as administrator user when you create or modify your Koalify account.

This personal data is processed in order to facilitate the delivery of the Koalify plugin and/or other products or services based on the execution of a contract which you have requested.

We will also use this personal data to inform you about updates on the products or services which you have bought.

• Contact information: email address, your question or remark, or other personal data send to us by email;

We process certain personal data when you use the contact form on the website or contact us via email. The information which we process depends upon the information you provide to us.

We process this personal data in order to reply to your request based on our legitimate interest or the execution of a contract (if you’re a customer). We may also process this information to send you marketing emails based on your consent (non-customers) or our legitimate interest (customers).

• Website or social media information: email address, your preferences,…

We may process personal data that you submit to our website, which includes social media or social networking websites operated by us. For example: when you provide feedback or when you participate in any interactive features, surveys, contests, promotions, sweepstakes, activities or events.

Koalify as well as our third-party partners, such as our advertising and analytics partners, may use cookies and other tracking technologies (e.g., web beacons, device identifiers and pixels) to provide functionality  and to recognize you across different services and devices. We process this personal data in order to reply to your request and improve or promote our services based on your consent or our legitimate interest. 

• Payment information: payment card details, company billing details

We may process certain payment and billing information when you register for paid services such as the Koalify plugin. 

This personal data is processed in order to facilitate the delivery of the Koalify-plugin and/or other products or services which you have requested based on the execution of a contract.

• Support channel information: email address, first and last name of contact person, phone number, other information you share when using our support channels.

When using our support services we may process certain personal data. Whether you designate yourself as a technical contact, open a support ticket, speak to one of our representatives directly or otherwise engage with our support team, you will be asked to provide contact information, a summary of the problem you are experiencing, and any other documentation, screenshots or information that would be helpful in resolving the issue.

We will use this personal data to resolve technical issues you encounter, to respond to your requests for assistance, to analyse crash information, and to repair and improve the services of the Koalify plugin based on the execution of a contract or our legitimate interest.

3. Security

Koalify implements reasonable and appropriate security measures to protect your personal data from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the risks involved in processing and the nature of such data, and comply with applicable laws and regulations. Koalify conducts penetration tests and audits of its servers and networks on a regular basis.

Please understand, however, that no security system is impenetrable. We cannot at all times guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet.

Any unauthorized access to or use of the Koalify plugin or information collected and maintained by Koalify should be immediately brought to our attention by sending us an email at info@koalify.io.

4. Third parties

Certain personal data collected by us will be transferred to and possibly processed by third party service providers. Such third parties may only process your personal data in accordance with very clearly defined instructions on our part.

In order to provide an optimal protection of your personal data, we have made the necessary contractual arrangements with all these external parties to ensure that:

• they have taken the necessary technical and organizational measures to securely process your personal data;
• their employees, subcontractors, representatives and specialized service providers appointed by them respect the confidential nature of your personal data; and that
• they only use your personal data for the purposes for which they were provided.

If necessary, your personal data may be passed on to other third parties. This could be the case, for example, if we were wholly or partially reorganized, our activities were transferred or if we were declared bankrupt. It is also possible that personal data must be transferred in response to a court order or to comply with a certain legal obligation.

In that case, we will make reasonable efforts to inform you in advance of this communication to other third parties.

However, you acknowledge and understand that in certain circumstances this may not always be technically or commercially feasible or that legal restrictions may apply.

We will under no circumstances sell or make your personal data commercially available to direct marketing agencies or similar service providers, unless with your prior consent.

5. Transfer of personal data outside of the EEA

We will only disclose your personal data to parties based outside the European Economic Area (EEA) under one of the following conditions:

• According to the European Commission, the country of destination offers an adequate level of protection;
• The country of destination does not in itself provide an adequate level of protection, but Koalify has entered into the necessary contractual arrangements with the party in question, taking into account the most recent version of the standard contractual clauses (SCCs) published by the European Commission.

6. Retention period

Your personal data are stored and processed by us for a period that is necessary in relation to the purposes of the processing and in relation to the (contractual or otherwise) relationship we have with you.

Account and profile information will in any case be deleted from our systems after a period of 3 years after the termination of your account, except for these personal data that we must keep for a longer period or in accordance with specific legislation or in case of an ongoing dispute for which the personal data are still necessary.

7. Your Data, your rights

You have a right to be informed of personal data processed by Koalify, a right to rectification/correction, erasure and restriction of processing. You also have the right to receive from Koalify a structured, common and machine-readable format of personal data you provided to us.

We can only identify you via your email address and we can only adhere to your request and provide information if we have personal data about you through you having made contact with us directly and/or you using our site and/or service.

Where you have provided consent, you may withdraw it at any time, without affecting the lawfulness of the processing that was carried out prior to withdrawing it. Whenever you withdraw consent, you acknowledge and accept that this may have a negative influence on the quality of the services or even impede the provision of certain services. You further agree that Koalify shall not be held liable with respect to any loss and/or damage to your personal data if you choose to withdraw consent.
